Judge Ridgway Tanjili of the Regional Trial Court (RTC) Branch 15 here recommended no bail for the temporary liberty against a detained 26-year-old Nigerian nursing student at the Davao City Jail after the City Prosecution Office (CPO) elevated in court the rape case filed by his 24-year-old schoolmate.
In an affidavit, the woman said she and the suspect came to know each other in their school.
The woman said sometime this month, she and the suspect incidentally met at the school canteen and ate together.
The woman said she and the suspect talked about missionary work as they had worked as missionaries before.
The woman said the suspect invited her to his house last week. When they entered the house, the suspect locked the door but she did not mind it since she trusted him considering that he was a preacher of God’s word.
The woman said the Nigerian played Nigerian music and invited her to dance with him.
She said she sat on the lap of the Nigerian during the dance, resulting in sexual abuse.
The woman said she ran towards the bathroom to wash herself. But when she came out, the Nigerian abused her again.
In his counter-affidavit, the Nigerian admitted having sex with his schoolmate but he asserted that there was no force, threat or intimidation when the sexual encounter happened on Sept. 17, 2010.
He even cited that it was the woman who came to his home in Dona Vicenta Village.
“Neither was there an instance mentioned that the complainant was deprived of reason or otherwise unconscious or fraudulent machination or grave abuse of authority was employed,” the Nigerian said through his lawyer Atty. Neil Jao.
The Nigerian also claimed that he was illegally arrested by policemen since no warrant of arrest was presented to him when he was collared.
